Preparing for your consultation

If you attach the documents you have to your request, your lawyer will review them before the meeting:

  • The construction contract (for FIDIC-based contracts, the General and Particular Conditions) and its annexes
  • Project documents, the programme of works and the cost estimate
  • Variation orders, engineer’s instructions and notices exchanged by the parties
  • Certificates of completed works, payment certificates and invoices
  • Correspondence and claims concerning delays, additional costs or defects
  • The construction permit and other permits (if any)

You can still contact us if you do not have all of them. We will identify what is missing together.

Frequently asked questions

Can a contractor claim for delay and additional costs?

Yes, where permitted under the contract. However, FIDIC contracts impose strict time limits for submitting claims, and failure to comply with these deadlines may result in the loss of entitlement to the claim.

How are construction disputes resolved?

Most contracts provide for disputes to be resolved through negotiations in the first instance, followed by arbitration or court proceedings if no settlement is reached. We assess the most effective dispute resolution strategy based on the contractual terms and the specific circumstances of the project.
