Public Procurement Law

Legal support for parties taking part in public procurement: reviewing tender documents and preparing bids, compliance with procurement procedures, public procurement contracts, and challenges and disputes arising from procurement decisions.

Public procurement is subject to strict formal requirements: a minor procedural error can lead to a bid being rejected or a contract opportunity being lost. We support companies at every stage of the procurement process — from preparing the bid to performing the contract.

Our Services

  • Advice on the requirements of the Law on Public Procurement and on procurement methods (open tender, two-stage tender, request for quotations, etc.)
  • Legal review of tender documents and support in preparing bids
  • Legal support when participating through the unified public procurement portal
  • Drafting and reviewing public procurement contracts and advising on their performance
  • Preparing complaints against decisions and actions of procurement commissions
  • Representation in disputes arising from procurement contracts, including before the courts

Our Approach

Timing is critical in public procurement, and the opportunities to file a complaint are limited by short deadlines. We therefore review documents in advance, identify risks before a bid is submitted and act quickly when needed. Our practical experience in construction projects gives clients an added advantage in construction and infrastructure tenders.

Preparing for your consultation

If you attach the documents you have to your request, your lawyer will review them before the meeting:

  • The tender notice, tender documents and any amendments to them
  • The bid documents you submitted or are preparing
  • Correspondence with the procuring entity, requests for clarification and the replies
  • The procurement contract and documents on its performance
  • If you wish to file a complaint: the notice of the outcome and the date you received it (complaint deadlines are short)

You can still contact us if you do not have all of them. We will identify what is missing together.

Frequently asked questions

Which procurement methods are used in public procurement?

The Law on Public Procurement provides for open tenders, two-stage tenders, restricted tenders, requests for quotations and single-source procurement. Which method applies depends on the value and nature of the procurement.

Is the procurement process conducted electronically?

Yes. Subject to the exceptions set out in the law (for example, procurement involving state secrets), public procurement is carried out through the unified public procurement portal.

Can I challenge a decision of the procurement commission?

Yes. Bidders may challenge decisions and actions of the procurement commission in the manner and within the time limits set by law. As these deadlines are short, we recommend seeking legal advice as soon as you receive a contested decision.
